vii) violate any applicable local, state, federal or international law, rule or regulation;
viii) become involved in any type of attack on the Website or the Services;
ix) attempt to gain unauthorized access to the Website, the Services or Accounts (including but not limited to Enterprise Accounts or Enterprise Representative Accounts) of others;
x) utilize any type of malicious software such as bots, spiders, viruses or other codes on or in conjunction with the Website or the Services;
xi) create derivative works of the Website or the proceeds of any of the Services;
xii) copy, frame or mirror any part of content of the Website without the written consent of Company;
xiii) access or utilize the Website or Services in order to build a competing product or service;

xix) have, use, generate, prompt, or promote revenge porn or use of actual, private individuals' image(s) without appropriate documented permission;
xx) acts of bestiality;
xxi) hate images or violence against specific groups or genders; or
xxii) depict illegal acts.If you make any upload, post or submission to the Website, then:
xxiii ) you remain owner of such upload, post or submission to the extent you were the owner;
xxiv) for materials for which the Services will be provided, for the purpose of provisioning Services to the party that submitted such material, you automatically grant on behalf of yourself or otherwise warrant that the owner of such content has expressly granted Company, a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, display, and/or otherwise exploit, the content in any media, or any form, format, or forum now known or hereafter developed (for avoidance of doubt, the Company may not use such rights except to provide the Services to the party that submitted such material. The rights granted to Company under this section does not grant to Company the right to use users materials for model training or redistribution without express written consent;
xxv) you acknowledge and agree that you are solely responsible and liable for the content of any images, product detail, product information, messaging, order content, buyer information, questions, data and feedback to submit to the Company or the Website; and
xxvi) you agree and warrant that Company may sublicense or assign its rights through multiple tiers of sublicenses or assigns.
Prohibited Content
The following content, included but not limited to text, images, videos, and any other AI-generated content created on our platform, is strictly prohibited:
a) Illegal Content: Content that contravenes local, national, or international laws and regulations is strictly prohibited. This includes, but is not limited to, content associated with illegal drugs, weapons, violence, or activities that advocate or endorse illegal actions.
b) Hate Speech and Discrimination: We do not tolerate content that promotes hate speech, discrimination, or harassment based on various factors, including race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic.
c) Violence and Harm: Content that encourages, glorifies, or promotes violence, self-harm, or harm to others is strictly prohibited. This includes content that endorses suicide, terrorism, or any form of harm.
d) Infringement on Privacy and Copyright: Any content that infringes upon the privacy, copyrights, trademarks, or intellectual property rights of individuals or entities is not permitted. This includes sharing personal information without consent, pirated content, or any unauthorized use of copyrighted material.
e) Impersonation and Celebrity Content: Deepfakes (as defined below), deceptive or harmful impersonation of real individuals, public figures, or celebrities is prohibited. This encompasses any misleading attempts to impersonate or misrepresent others.
f) Non-Consensual Intimate Imagery and Deepfakes: We have a zero-tolerance policy for the creation or attempted creation of non-consensual imagery and intimate imagery, videos, sound, images and other likenesses intended to resemble actual persons (“Deepfakes”). This content will be removed and appropriate action will be taken against anyone found violating this policy. Company will remove reported non-consensual intimate imagery within 24 hours of verification and will provide a dedicated takedown request mechanism for affected individuals, which is through our CONTENT REMOVAL FORM - https://form.typeform.com/to/Hvy5w0JR
g) and CSAM:
CSAM and Child Safety
Child Exploitation: Child sexual abuse material is “CSAM”, which includes but is not limited to real, synthetic, and/or AI generated materials and sexual or abusive depictions of a minor. We have a zero-tolerance policy toward CSAM, and any content or attempt to create content that exploits or endangers minors, including but not limited to CSAM, sexual exploitation, or any form of harm or harassment towards minors.
Content Resembling Minors: It is strictly prohibited trying to generate, prompt, upload real, simulated, or AI content resembling or simulating minors, which is also considered by us to be CSAM. We are committed to ensuring that AI-generated content on our platform does not bear any resemblance to minors or exploit their likeness. You acknowledge that it is our intention and right that any attempts to do the foregoing will be flagged, reviewed, and removed by our automatic and/or other procedures. We will immediately disable any account, and we reserve the right to terminate any account, that attempts to violate our CSAM policies or is flagged by our systems and procedures, even if it results in terminating your associated subscription and/or account immediately. We will immediately quarantine and preserve securely for law enforcement all CSAM, and will share such with appropriate authorities, including but not limited to the National Center for Missing and Exploited Children (“NCMEC”) CyberTipline and local authorities. As required by law, we will not inform you if we if we consider you to have violated our CSAM policies.
You are agreeing that our CSAM policies supersede and take precedence over any conflicting terms or obligation we may have to you.
